Orchard Outdoor Living schedules visits in advance and allocates time specifically to each client. We ask that clients give reasonable notice of any changes so we can manage our schedule fairly for all clients.

Maintenance Plan Visits

A minimum of 48 hours' notice is requested to reschedule or cancel a planned maintenance visit.
Cancellations made with less than 24 hours' notice, or on the day of the visit, may be charged at a 50% of service cost fee.
Visits cancelled by Orchard Outdoor Living due to adverse weather or unforeseen circumstances will be rescheduled at the next available opportunity at no additional charge.

Monthly Plan Cancellation

Clients wishing to cancel their monthly maintenance plan must give one calendar month's written notice by email to hello@orchardoutdoorliving.co.uk.
Orchard Outdoor Living reserves the right to terminate a service agreement with one calendar month's written notice.

2.Payment Terms

Clear payment terms allow us to maintain a reliable service for all clients. All prices are quoted inclusive of labour. Materials are charged separately where applicable if requested by client.

Monthly Maintenance Plans

Monthly plan fees are collected by direct debit on or around the 1st of each calendar month.
Invoices are issued through the Jobber client portal and available for download at any time.
If a direct debit payment fails, Orchard Outdoor Living will notify the client and allow 5 working days for the payment to be resolved before suspending the service.

One-Off & Ad Hoc Work

Invoices for one-off and ad hoc visits are due within 7 days of the invoice date.
Payment can be made by bank transfer (details on invoice) or through the Jobber client portal via card. Card fees apply.

Landscaping & Project Work

A deposit of 50% of the quoted project value is required before work commences. This deposit is non-refundable in the event of client cancellation within 5 working days of the start date.
The remaining balance is due within 7 days of project completion.
Where a project extends over multiple weeks, interim invoices may be raised and are due within 7 days of issue.

Late Payment

Invoices not settled within the agreed payment period may incur a late payment charge of 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
Orchard Outdoor Living reserves the right to suspend services where invoices remain unpaid beyond 30 days of the due date.

3.Health & Safety Policy

Orchard Outdoor Living is committed to carrying out all work safely and in accordance with applicable health and safety legislation, including the Health and Safety at Work Act 1974 and associated regulations.

Our Commitments

All work is carried out using well-maintained, appropriate equipment that is regularly inspected for safety.
COSHH (Control of Substances Hazardous to Health) assessments are completed and maintained for all chemicals and treatments used on site.
Personal protective equipment (PPE) is worn at all times appropriate to the task being carried out.
Risk assessments are conducted prior to any work, whether regular or non-standard or complex work.

Client Responsibilities

Clients must notify Orchard Outdoor Living of any known hazards on the property prior to the first visit, including but not limited to: underground services, unstable structures, aggressive animals, or restricted access areas.
Clients must ensure that children and pets are kept away from the work area during visits.
Any change to site conditions that may affect safety must be communicated to Orchard Outdoor Living before the next scheduled visit.
All pet excrement must be removed due to service. This is for health purposes and to prevent damage to equipment. We reserve the right to delay or cancel service if this is not rectified.

4.Public Liability & Insurance

Orchard Outdoor Living carries the following insurance cover for the protection of clients and third parties:

Public Liability Insurance: £5,000,000 (five million pounds) per claim.
Employer's Liability Insurance: in place when staff are employed.

Copies of current insurance certificates are available on request. Commercial clients, schools, and local authorities requiring evidence of insurance cover should email hello@orchardoutdoorliving.co.uk.

Limitations

Insurance cover does not extend to pre-existing damage, fair wear and tear, or damage caused by client-side factors beyond our reasonable control. Any claim must be reported to Orchard Outdoor Living within 48 hours of the incident being identified.

5.Bad Weather & Access Policy

Adverse Weather

Orchard Outdoor Living will proceed with scheduled visits in all normal weather conditions. Light rain does not prevent most garden maintenance work.
Visits may be postponed in the following conditions: severe wind (making use of power equipment unsafe), heavy or prolonged rain that renders lawn work inadvisable, ground frost that prevents safe mowing, or ice that makes site access unsafe.
Where a visit is postponed by Orchard Outdoor Living due to weather, the client will be notified as early as possible and the visit will be rescheduled at the next available date at no additional charge.
Monthly plan fees are not reduced for weather-related postponements where the visit is rescheduled within the same calendar month.

Access

Clients are responsible for ensuring access to the garden is available on the scheduled visit date. This includes gates being unlocked, access codes being current, and any dogs or animals being secured.
Where access cannot be gained and no prior notice was given by the client, the visit will be treated as a client-side cancellation and may be charged at the standard visit rate.
Orchard Outdoor Living will attempt to contact the client upon failing to gain access before leaving the property.

6.Damage Policy

Orchard Outdoor Living takes all reasonable care when working on client properties. In the event that damage occurs as a direct result of our work, the following process applies.

Reporting Damage

Any damage believed to have been caused by Orchard Outdoor Living must be reported within 48 hours of the visit in question.
Reports should be made by email to hello@orchardoutdoorliving.co.uk with photographs and a description of the damage.
Damage reported after 48 hours may not be attributable to the visit and will be assessed on a case-by-case basis.

Our Liability

Where damage is confirmed to have been caused by Orchard Outdoor Living, we will arrange repair or replacement at our cost, up to the limit of our public liability insurance.
We are not liable for damage caused by pre-existing conditions, concealed hazards not disclosed by the client, fair wear and tear, or acts of nature.
We are not liable for damage to unmarked underground services, irrigation systems, or structures not clearly visible at ground level.

Clients are encouraged to notify us of any underground features, irrigation, or sensitive structures before the first visit. This allows us to work around them safely.

7.Privacy Policy

Orchard Outdoor Living (\"we\", \"us\", \"our\") is committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

What Data We Collect

Contact information: name, address, email address, and telephone number.
Property information: garden address, access details, and service history.
Financial information: payment records via GoCardless and Jobber. We do not store card details.
Photographic records: before-and-after photographs taken during visits for service documentation.
Communications: emails, messages, and notes related to your account.

How We Use Your Data

To provide and manage the services you have requested.
To process payments and issue invoices.
To communicate with you about your service, upcoming visits, and any issues arising.
To maintain a record of work carried out on your property.
To comply with our legal and insurance obligations.

How Long We Keep Your Data

Client records are retained for 6 years after the end of the service relationship, in line with HMRC requirements.
Photographic records are retained for the duration of the client relationship and for 12 months thereafter.

Your Rights

Under UK GDPR you have the right to access, correct, or request deletion of your personal data. To exercise any of these rights, please email hello@orchardoutdoorliving.co.uk. We will respond within 30 days.

Third Parties

We use Jobber (field service management) and GoCardless (payment processing) to manage client accounts and payments. Both are GDPR-compliant processors. We do not sell or share your data with any other third parties.

8.Photography & Marketing Consent

Service Photography

Orchard Outdoor Living photographs gardens before and after every visit as part of our standard service documentation. These photographs are stored securely in your Jobber client record and are available to you via the client portal at any time. Service photographs are taken for operational purposes and are not used for marketing without separate consent.

Marketing Use

We may wish to use before-and-after photographs or video of completed work on our website, social media channels, or in printed marketing materials. We will only do so where the client has given explicit written or digital consent and we understand the need for privacy and discretion.

Consent to use photographs for marketing purposes can be given or withdrawn at any time by emailing hello@orchardoutdoorliving.co.uk. Withdrawing consent will not affect your service.

Where photographs are used, property addresses and personal details will never be included or identifiable without express permission.

9.Terms & Conditions of Service

These Terms & Conditions (\"Terms\") govern the provision of all services by Orchard Outdoor Living (\"the Company\") to clients (\"the Client\"). By accepting a quote or commencing a service, the Client agrees to these Terms in full.

1. Scope of Services

The Company will provide the services set out in the agreed quote or service plan. Any additional work requested beyond the agreed scope will be quoted separately and requires written approval before it is carried out. Verbal instructions to proceed with additional work do not constitute authorisation.

2. Quotes & Estimates

All quotes are valid for 30 days from the date of issue. Quotes are based on a site assessment or the information provided by the Client at the time of quoting. If site conditions differ materially from those assessed, the Company reserves the right to revise the quote before work commences. Estimates (as distinct from fixed quotes) are indicative only.

3. Service Standards

The Company will carry out all work to a professional standard, using appropriate equipment and qualified personnel. All visits will be documented with photographic records available via the Jobber client portal.

4. Client Obligations

The Client is responsible for: providing safe and unobstructed access to the property on agreed visit dates; disclosing any known hazards on the property; ensuring pets and children are kept away from the work area during visits; and providing accurate information regarding the property and any specific requirements.

5. Payment

Payment terms are as set out in the Payment Terms policy (Section 2 of this document). The Company reserves the right to suspend services where payment obligations are not met and to recover reasonable costs of doing so.

6. Liability

The Company's total liability to the Client for any claim arising from the provision of services shall not exceed the value of the services provided in the preceding three months, except in cases of death or personal injury caused by negligence, where liability is not limited. The Company is not liable for indirect or consequential loss.

7. Termination

Either party may terminate a monthly service plan with one calendar month's written notice. The Company may terminate a service immediately where: the Client has acted in a threatening or abusive manner; payment obligations have not been met after reasonable notice; or access to the property cannot be reliably secured.

8. Force Majeure

The Company shall not be liable for failure to perform services where this is caused by circumstances beyond our reasonable control, including but not limited to severe weather, illness, or national emergency. In such cases we will make every effort to reschedule at the earliest opportunity.

9. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Amendments

Orchard Outdoor Living reserves the right to update these Terms and Conditions. Clients will be notified of any material changes by email. Continued use of the service following notification constitutes acceptance of the updated terms.
